IMPORTANT UPDATE FOR CAREGIVERS & EMPLOYERS

New Ontario & Federal Legislation

Employment Protection for Foreign Nationals Act (Live-in Caregivers and Others), 2009

As such , employers are now responsible for paying the following (see above links):

1) Agency Fee

2) One Way Airfare to Canada from wherever caregiver is currently working in the world.

3) 3 months equivalent of Provincial Health - such as Blue Cross

IMPORTANT

Effective April 1, 2010, live-in caregivers working in Canada under the Live-in Caregiver Program:

have two options for calculating their work experience to be eligible to apply for permanent residence:
24 months of authorized full-time employment, or
a total of 3,900 hours of authorized full-time employment;
have four years from their date of arrival to complete the employment requirement to be eligible for permanent residence under the Program; and
no longer need to undergo the standard mandatory requirement for a second medical exam when applying for permanent residence.

RUMOUR FALSE!!

There has been a rumour circulating all over the world that all new foreign workers who come to Canada as a live-in caregiver will NOT be eligible to obtain LANDED STATUS after working 24 months full time. This rumour is 100% FALSE! A simple call to 1-888-242-2100 , i.e. CIC customer service line, and asking them about it, verifies this. Until now, I had no clue as to WHY this rumour got started. I have now ascertained what started it. Some VERY VERY SNEAKY agencies looking to bypass the 2 year + processing time in the Philippines applied the caregivers for unskilled labour contracts instead of filing them through the caregiver program. As everyone knows, the unskilled worker applications get fast tracked, which excited the workers at first, some 200-300 of them. However, when they arrived in Canada, and found out that their WORK PERMITS did not state they were under the nannies/caregivers program, they became heartbroken. PLEASE make sure you look over your LABOUR MARKET OPINION and contracts, and always deal with an agency that has a great reputation. If in doubt, ask to speak to several of the agency's clients. I am always willing to provide phone numbers to prospective clients. However, one of my greatest assets has been the power of REFERRAL, so I don't have to advertise for caregivers or employers.

IMPORTANT UPDATE CONCERNING PROCESSING TIME FOR CAREGIVERS COMING FROM HONG KONG

It appears that since August 1, 2009, all candidates must mail in their applications to the Canadian Consulate. Once the embassy has the application, it takes approximately 3 weeks for the embassy to issue notice for medical and police clearance. The candidate then waits one to two weeks for request to submit their passport and release/job letter from their employer in Hong Kong.

 

IMPORTANT UPDATE TO ALL EMPLOYERS FROM HRSDC

EFFECTIVE MAY 4, 2009 - ADVERTISING IS ONCE AGAIN MANDATORY AND RULES HAVE CHANGED FURTHER. WE MUST UNDERGO 2 WEEKS OF ADVERTISING THE POSITION IN CANADA BEFORE APPLYING FOR A FOREIGN CAREGIVER, WHETHER OR NOT THEY ARE HERE IN CANADA ALREADY OR OVERSEAS.

IMPORTANT NEWS FOR CAREGIVERS - updated Sept 8, 2009

It still appears that caregivers who return home to the Philippines before coming to Canada are being subjected to not just the PDOS (Pre Departure Orientation Seminar), but are also being forced to send a "contract" addendum to the employer. Therefore, effective immediately, it is strongly RECOMMENDED for all our candidates to visit home BEFORE you get your Canada Visa. Do not go home after getting your Visa.

The 4 additions from POLO are:

Employer is responsible for:

1) Cost of 2 way transportation to and from Canada.

2) Health coverage for the employee before the provincial health insurance applies

3) Termination of employment shall only be for cause.

4) In case of work related death, cost of repatriation of remains to the Philippines.
